Terms of Use

These Terms of Use ("Terms") set forth the conditions for using the video analysis player "SyncMotion" ("Service") provided by Never Inc. ("Company"). Please read these Terms carefully and agree to them before using the Service.

Definitions

• "Service": The video analysis player and related services operated by the Company.
• "User": Anyone who uses the Service.
• "Video Data": Video files that Users play and analyze with the Service.
• "Analysis Processing": Functions provided by the Service such as clipping playback sections, repeat playback, freehand drawing, frame-by-frame playback, and horizontal flipping.
• "Personal Information": Information that can identify a specific individual such as name, address, phone number, or email address.

Consent to the Terms

Users may use the Service only after agreeing to these Terms. When a User downloads the Service to a smartphone or other device and completes the procedure to agree to these Terms, a usage agreement under these Terms is deemed to have been concluded between the User and the Company.

Changes to the Terms

The Company may change these Terms without the User's prior consent. The revised Terms will take effect when the Company notifies Users by a method separately prescribed by the Company. If a User continues to use the Service after such changes, the User is deemed to have agreed to the revised Terms.

Notices

• The Service is intended for video analysis. The Company makes no guarantees regarding any analysis results.
• Analysis processing uses the resources of the User's device. Please be aware of your device's performance and storage capacity.
• For details on supported formats and functions, please refer to the guidance within the app.

Privacy and Data Handling

• The Service processes Video Data locally on the User's device. Video Data is not sent to any server.
• The Company does not collect or store any analysis results or Video Data.
• Only anonymous analysis logs and usage statistics are collected and used to improve the Service.

Prohibited Acts

• Using the Service for unlawful purposes.
• Acts that violate laws or public order and morals.
• Acts that interfere with the operation of the Service.
• Any other acts the Company deems inappropriate.

Disclaimer

• The Company shall bear no responsibility for any damages arising from the use of the Service.
• The Company shall not be liable for any damages arising from changes to, interruption of, or termination of the Service.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute between the User and the Company in relation to the Service shall be subject to the exclusive jurisdiction of the Osaka Summary Court or the Osaka District Court.

In-App Purchases

• Some features may require a non-consumable in-app purchase or a subscription.
• A non-consumable in-app purchase can be used permanently without additional charges on the same Apple ID or Google account once purchased.
• Purchased non-consumables can be restored from "Restore" within the app.
• Unlike consumables, non-consumables have no usage limits or expiry.
• The contents, pricing, and conditions of subscriptions will be provided within the app or in the store.
• Subscriptions are billed based on a contract between the User and each app store.
• To cancel, follow each store's procedure at least 24 hours before the renewal date.
• Due to the nature of digital products, refunds or cancellations after purchase are not available.

Use of Brand Images

The Service's brand images (logos, icons, etc.) may be used free of charge for both commercial and non-commercial purposes. However, use that is contrary to public order and morals, or that may cause misunderstanding, is prohibited.
